TWO CONSTITUTIONAL COURT SUCCESSES TODAY

It’s not often that you obtain two successful outcomes in the Constitutional Court on the same day! 

First the Constitutional Court refused leave to Appeal against the judgment of the Supreme Court of Appeal which upheld the High Court order which in turn dismissed the claim brought by the plaintiffs for in excess of one billion rand in damages against our client SAP Systems (Twenty Third Century Systems Pty Ltd and SAP Africa Region CCT 123/25)! 

Secondly, a critical decision of the Constitutional Court in relation to intervention in merger proceedings where the Court upheld the appeal against the decision of the Competition Appeal Court and thereby reinstated the Tribunal’s order granting intervention to our client Lewis furniture stores (Lewis stores and Pepkor Holdings Limited and Shoprite Holdings Limited CCT 316/25).
