Commercial Litigation and Disputes

Nortons has extensive experience in commercial litigation and disputes across multiple industries, including our recent successful representation of the German software company SAP in a contractual dispute in which the contracting party instituted a claim for damages against our client for approximately USD68 million.

         âš¬ Nortons successfully represented the client before the High Court where the claim was dismissed.

         âš¬ The appeal against the High Court’s findings was also recently dismissed by the Supreme Court of Appeal.

We have also represented numerous clients in securing relief in relation to unlawful competition (breaches of restraint of trade, stealing of corporate secrets and other aspects of unlawful competition).

Public Interest Litigation, Constitutional and Administrative Law

We challenge laws and policies that violate constitutional rights, ensuring that the foundational principles of our legal system are protected.

Nortons has been involved in numerous seminal Constitutional Court cases in South Africa including:

         âš¬ the precedent-setting AllPay decision dealing with the social grant tender;

         âš¬ the analogue switch-off case relating to ensuring that poor South Africans are not cut off from access to television;

         âš¬ the challenges to the processes of the Judicial Service Commission;

         âš¬ the Constitutional Court cases relating to the purported extension of the term of office of the former Chief Justice;

         âš¬ the attempt to postpone the local elections in 2021; and

         âš¬ the current challenge to the National Health Insurance legislation on behalf of the Hospital Association of South Africa.

We have also been involved in several constitutional cases relating to the provisions of the Competition Act and the ambit of unlawful competition in a constitutional setting.
