NORTONS REPRESENTING FIRST BATTERY IN REVIEW APPLICATION

Nortons is representing First Battery in a review application launched by an unsuccessful bidder in a tender process conducted by First Battery to appoint a service provider to provide transport services. One of the issues which the High Court is required to consider is whether it has jurisdiction to adjudicate the review of a private tender process. Nortons has argued on behalf of First Battery that the Court does not enjoy such jurisdiction and that the review application should be dismissed on, inter alia, this basis. The matter was argued before the High Court on 16 April. We are currently awaiting judgment.
